How do you identify your mortgage loan type?
Review your closing documents and recent mortgage correspondence, then ask the servicer to confirm the program in writing. The company collecting your payments is not necessarily the agency insuring or guaranteeing the loan. A lender’s name alone does not establish the loan type.
Ask: “Is this an FHA, VA, USDA Guaranteed, USDA Direct, or conventional loan, and which assistance rules apply?” If it is USDA, the Direct-versus-Guaranteed distinction matters. The CFPB explains how to identify your loan and contact the appropriate agency.
Confirm FHA insurance and ask about current home-retention options.
Contact the servicer and use VA’s loan-assistance resources.
Establish whether the loan is Direct or Guaranteed before comparing options.
What should you ask about an FHA loan in foreclosure?
FHA has loss-mitigation options intended to help eligible borrowers retain their homes. Depending on current rules and individual eligibility, a review may involve a partial claim, a loan modification, or another permitted arrangement. These options are not interchangeable, and earlier assistance can affect a later review.
Ask the servicer to identify the options considered, what it still needs from you, and why an option was denied. For a proposed partial claim or other arrangement, ask what amount remains owed, when it must be repaid, and what documents you must sign. Do not read “assistance” as automatic debt forgiveness.
HUD’s requirements change. Mortgagee Letter 2026-08, for example, updated trial-payment and loss-mitigation review requirements. Use HUD’s current mortgagee letters and ask which requirements govern your review, rather than relying on an older article’s program checklist.
What assistance may be available for a VA-backed loan?
VA’s homeowner guidance describes options including repayment arrangements, modifications, and its Partial Claim Program. Availability depends on the loan, program rules, and the servicer’s review. VA loan technicians can also help borrowers understand available assistance.
As checked on October 29, 2026, VA says its Partial Claim Program is open for submissions and servicers have until November 28, 2026, to add it to their systems. Ask your servicer about its implementation and your eligibility. The older VASP program stopped accepting submissions on May 1, 2025; an old VASP article is not evidence that you can enroll now.
Use VA’s current foreclosure-assistance page and its VASP closeout information. Ask how any proposed agreement affects future payments and amounts still owed.
How are USDA Direct and Guaranteed loans different?
A USDA Direct loan is made through USDA Rural Development. A USDA Guaranteed loan is made by a participating lender with a USDA guarantee. The appropriate contact and servicing process differ, so a general reference to a “USDA loan” is not enough.
For a Direct loan, contact USDA’s servicing office about your account and current assistance options. For a Guaranteed loan, start with the company servicing the mortgage and ask for a review under the applicable USDA requirements. USDA provides loan-servicing contact guidance; Direct borrowers can also review the My RD Loan Portal.
Does applying for assistance stop the Florida foreclosure lawsuit?
Not automatically. Certain protections may apply to a qualifying loss-mitigation application, but they depend on matters such as timing, completeness, loan coverage, and prior applications. A phone conversation or document upload is not proof that the lawsuit or auction has stopped.
Track the assistance application and the court case separately. Keep submission receipts and written acknowledgments, check what remains outstanding, and obtain confirmation of any changed sale date. Continue addressing the summons, motions, and hearing notices. See loan modification during foreclosure and what to do after receiving court papers. Federal procedural protections are described in Regulation X, §1024.41.
Six questions to ask your servicer
- Which loan program applies to my account?
- Which current assistance options are you considering?
- What documents are missing, and when are they due?
- Have you acknowledged a complete application in writing?
- Is foreclosure activity restricted or paused, and what is the current sale status?
- If assistance is denied, what reason and review or appeal information will I receive?
Write down the date, representative’s name, and reference number for each conversation. Save the actual letters and uploaded documents. If an amount or payment history looks wrong, see our mortgage-servicing errors guide.
Common questions
Can an FHA or VA loan still be foreclosed?
Yes. Federal insurance or a guarantee does not prevent foreclosure. Assistance and servicing requirements may affect the available options and how the matter should proceed.
Do I need to wait for a denial before getting legal advice?
No. If you have been sued or have a hearing or sale date, address those deadlines while the assistance review continues.
What if an older program is no longer available?
Ask which current alternatives apply to your loan. Keep earlier approval letters or agreements because an existing arrangement may present different questions from a new application.
