How can bankruptcy stop foreclosure?
Filing a bankruptcy petition generally triggers an automatic stay, a federal protection that stops many collection actions, including a pending foreclosure. Merely consulting an attorney, completing an intake form, or telling the lender that you intend to file does not create that protection.
The stay has exceptions. A lender may ask the bankruptcy court for permission to proceed, and earlier bankruptcy cases or orders can affect whether a stay takes effect and how long it lasts. Review the actual case history before relying on it. Federal court explanation of the automatic stay.
How does Chapter 13 address missed mortgage payments?
Chapter 13 is a repayment process for eligible individuals with regular income. Eligibility also includes debt limits and other requirements; the applicable limits should be checked when evaluating a filing. Plans generally run for three to five years. For an eligible long-term home mortgage, a plan may provide for curing past-due payments while maintaining ongoing mortgage payments.
The practical question is whether the proposed budget works. Catching up on arrears is only one part of the obligation: current mortgage payments, other required plan payments, living expenses, taxes, and insurance also matter. A filing is not a substitute for an affordable plan. U.S. Courts: Chapter 13 basics.
Identify the sale date, court orders, loan balance, and earlier bankruptcy filings.
Compare reliable income with ongoing expenses and the proposed repayment obligations.
Consider bankruptcy alongside a modification, reinstatement, sale, or continued foreclosure defense.
Can bankruptcy stop a foreclosure sale that is already scheduled?
It may, if a qualifying case is filed in time and an effective stay applies. But an approaching auction is not a reason to assume that a last-minute filing is available or sufficient. Counsel must review eligibility, prior cases, necessary documents, and the effect of any existing orders.
Federal law limits the ability to cure a home-mortgage default through Chapter 13 once the residence has been sold at a foreclosure sale under applicable law. Do not assume the objection period or the later transfer of title gives you extra time to use this remedy. See 11 U.S.C. §1322 and our guide to stopping a Florida foreclosure sale.
What about an emergency bankruptcy filing?
An urgent sale does not erase filing requirements. Individuals generally must complete approved credit counseling before filing, subject to limited exceptions. Tell the attorney immediately about the sale date and whether counseling has been completed. Do not assume it can always be completed after filing. 11 U.S.C. §109.
Bring the complete foreclosure packet, recent mortgage statements, income records, a list of debts, and records of earlier bankruptcy cases. An attorney needs the full picture, not just the auction notice. Our consultation checklist can help organize the foreclosure documents.
What if you have filed bankruptcy before?
Disclose every earlier filing, especially a case dismissed within the past year. Repeat filings can limit or prevent the automatic stay, and obtaining protection may require additional court action. Do not assume that filing another petition starts the same protection again. Prior orders concerning the property also need review.
Is bankruptcy the only way to stop foreclosure?
No. Depending on your documents, finances, and timing, alternatives may include reinstatement, a loan modification, selling the home, or defending issues in the lawsuit. Bankruptcy has broader financial consequences and should be evaluated alongside those choices.
Keep the foreclosure papers and assistance correspondence together. A pending modification request and a bankruptcy filing are different events with different legal effects.
Common questions
Does Chapter 7 bankruptcy stop foreclosure?
A Chapter 7 filing may trigger an automatic stay, subject to exceptions and limits. But Chapter 7 does not provide Chapter 13’s repayment-plan mechanism for catching up on mortgage arrears. A temporary pause does not itself resolve the default or guarantee that you can keep the home. Have an attorney compare the available chapters and their consequences before deciding. See U.S. Courts: Chapter 7 basics.
How long will Chapter 13 delay foreclosure?
There is no guaranteed delay. The stay, court orders, payment performance, and outcome of the bankruptcy case control what happens. A three-to-five-year repayment plan is not a promise that foreclosure cannot resume during that period.
Will bankruptcy erase my mortgage?
Do not assume so. Chapter 13 can provide a way to address arrears and maintain payments; it is not an automatic cancellation of the mortgage or the lender’s lien.
Can I stop paying once I file?
Do not assume payments stop. Ask counsel exactly which mortgage and plan payments are due, when they are due, and how they must be paid.
